Arrest or Conviction in Russia: A Practical Legal Guide for Families Living Abroad

Receiving the news that someone close to you has been detained, accused of an offence, or given a prison sentence in Russia can leave a family uncertain about what to do next – particularly when you are following the case from abroad, have little or no knowledge of Russian, and know only parts of what has happened. Russia’s criminal procedure is complex even for people who live in the country; for a family abroad, the combination of language barriers, distance, and unfamiliar procedure multiply the confusion.
This practical guide, prepared by the criminal practice team of Yalanzhi & Partners in Moscow, explains what can be expected at every major stage of a Russian criminal case, which procedural deadlines are critical, which mistakes can seriously damage the defence, and what legal options may realistically remain available – even after a conviction has been entered.

Start with verified facts, not promises

Before any realistic legal assessment can be made, the family must establish several essential facts: where the person is being held, which investigative body is handling the case, what criminal offence the person is suspected or accused of committing, whether the person has been formally charged, whether the court has imposed detention as a preventive measure, and whether the person already has a defence lawyer, whether appointed by the state or retained privately. For foreign citizens, several further matters must be established around access to an interpreter, contact with the relevant consulate, and communication with family members. The earlier an experienced independent defence lawyer reviews the situation, the greater the range of legal options that may still be available. Work done at the investigation stage – challenging procedural violations, contesting evidence, and formally recording mitigating factors – later becomes the foundation for any appeal. This is what defence during the investigation is really about: protecting the person now while building the record for the future.

Charges foreign nationals face most often

From our experience with criminal cases involving foreign nationals, foreign citizens in Russia are often prosecuted under a recognisable set of provisions of the Russian Criminal Code. These include Article 228 and Article 228.1 (offences involving possession and trafficking of narcotic substances), Article 229.1 (drug smuggling – a common airport scenario), Article 159 (fraud-related offences), Articles 111 and 112 (intentional infliction of bodily injury), Articles 131 and 132 (sexual offences), Article 105 (murder), and Article 322 (unlawful crossing of the state border). Each category has its own evidentiary patterns and its own body of appellate practice, which must be taken into account when developing the defence. The trial and the importance of preserving the record

The statistical rate of acquittal at first instance in Russia is extremely low. Families should view this not as a reason to give up, but as a reason to approach the case realistically: in the Russian system, important legal issues are often contested during appellate and cassation review. And those courts base much of their review on the procedural record created below. If mitigating circumstances were never documented, if the admissibility of key evidence was never challenged, if arguments concerning the correct legal classification were not placed on the record – raising these points later becomes far harder. A strong trial defence therefore serves two purposes simultaneously: defending the case before the trial court while preserving grounds for subsequent review.

After a guilty verdict: the legal routes that remain available

A conviction does not mean that every legal remedy has been exhausted. Russian law sets out a structured sequence of review mechanisms. An appellate appeal generally must be lodged within 15 days under Article 389.4 of the Code of Criminal Procedure; for a convicted person who remains in detention, the period is calculated from the date on which the judgment is formally delivered to them. A particularly important point is that, on an appeal brought solely by the defence, the court cannot worsen the convicted person’s position – the law prohibits it – so the defence does not create a risk of a worse result simply by filing such an appeal. Once the judgment has taken legal effect, a cassation appeal may be pursued: the first, mandatory cassation review must be requested within 6 months, while further review – including a petition to the Supreme Court of the Russian Federation – is not limited by a strict deadline where it seeks to improve the convicted person’s position. There are cases in which convictions are changed or set aside years after entering into legal force when the defence finds substantial legal grounds capable of affecting the judgment. A procedural deadline that has already expired, if missed for a legally recognised reason, can potentially be restored through a court application.

How Yalanzhi & Partners evaluates a case – before asking for any fee

Our post-conviction work always starts the same way: with the documents, not with promises. We normally ask relatives to provide the judgment and, if reviews have already taken place, the appellate and cassation rulings – the documents can be sent as scans or readable photographs. The text is converted into searchable digital form and matched with our internal database of 136,000 Russian criminal cases in which sentences were amended or reduced, or judgments were set aside, indexed by charge, factual pattern, type of violation, region, and court level.
Our lawyers then review the matches and determine whether established judicial practice realistically supports a challenge. This preliminary legal analysis is carried out free of charge, and in around 80 percent of the cases we initially review our initial conclusion is that the prospects are weak – the judgment is legally sound on the issues reviewed, or the relevant judicial practice does not provide sufficiently consistent support. Families abroad are especially vulnerable to people selling hope; we would rather decline a case than sell false hope. When the review identifies a viable basis for further proceedings, the client sees, before signing anything, exactly which court rulings the defence will be built on.

Serving a prison sentence: parole and a milder punishment

For those currently serving a prison sentence, the law provides two important routes that may become available: conditional early release (parole, Article 79 of the Criminal Code) and commutation of the unserved part of the sentence to a less severe form of punishment under Article 80, which may include a move to a less restrictive form of punishment. Eligibility is determined by the category of the offence and how much of the sentence has already been served; conduct history, employment, restitution, family circumstances and other supporting documents can play a major role, making early preparation essential. Working with families abroad without requiring travel

Our work is organised so that cases can be handled remotely: documents are transferred in digital form, and representation before regional appellate and cassation courts can be coordinated using court videoconferencing – a recognised and routinely used legal procedure. A note of caution

Be extremely careful with anyone who claims that a particular court result is certain, claims to have «special connections», or pushes you to transfer money quickly and keep the arrangement secret.
